REGISTRY PERMIT PROCEDURE

“Granting of residence permit to property owners in Greece”

According to article 6 paragraph 2 of Greek Law 4146/2013, article 36A was added to Greek law 3386/2005 according to which a non EU citizen can obtain a 5 year residence permit in Greece provided that the indicated in the contract, or in the notarial lease document if it concerns a ten year lease of hotels or accommodations, value is at least higher than 250.000 €.

The procedure is the following:

VISA

a) The non EU citizen shall address to the Greek consulate of the place of residence and ask for the granting of VISA type D or VISA type C.
The following documents are provided for the granting of the VISA :

  • Passport
  • One colored picture
  • Copy of criminal record of the country of origin
  • Travel Insurance
  • Medical Certificate
  • Evidence of property purchase (copy of a public contract for the purchase of property higher than 250.000 €) or other document that proves that the non EU citizen has the opportunity and the intention to afford such a purchase (contract award with a law firm or a real estate company) in case such a purchase hasn’ t been completed yet.
  • Certificate of the submission of the contract before the competent land registry or
    copy of lease contract with reference to the granting of license from the National Tourism Organization and certificate of submission of the lease contract before the competent land registry in case of a ten year lease of an accommodation.
  • Declaration from the notary that the purchase contract is in line with the prerequisites of article 6 paragraph 2 of Greek law 4146/2013 and Copy of the corporation charter of the legal person in which it will be indicated that the non EU citizen is the only shareholder, in case the property is purchased by this legal person.

B) The non EU citizen can enter the Greek state since he is granted with the VISA and he can either apply as soon as possible for a registry permit, if the procedure of the property purchase has already been completed, or continue with the procedure that is required for the completion of the investment.

In any case, the whole procedure must be completed prior to the expiry of the VISA, since the application for the granting of a registry permit must be submitted prior to the expiry of the VISA.

REGISTRY PERMIT

Α) The application for the granting of a registry permit is submitted to the one – stop shop of the competent Direction of the Decentralized Administration of the applicant’s place of residence or in some cases to the competent service of the Municipality of the applicant’s place of residence.
The submission of the applications for granting a registry permit, the submission of all the required documents and the granting of the registry permit or its rejection or of any other document from the case file could be done in person or by proxy.

The application for a registry permit must be accompanied with the following documents:

  • Three (3) colored recent pictures.
  • Exact copy of a valid passport or of a travel document recognized in the country with the valid visa.
  • Medical certificate from a Greek state hospital or private doctor which will certify that the non EU citizen does not suffer from any disease, which according to the international community and the World Health Organization, could endanger public health.

B) And the following especially for each category documents:

Owners with full ownership and possession rights of property in Greece:

  • Copy of a purchase contract as regards property of a minimum value of 250.000 €.
  • Declaration from the notary that the purchase contract is in line with the prerequisites of article 6 paragraph 2 of Greek law 4146/2013.
  • Certificate of the submission of the contract before the competent land registry.
  • Certificate of insurance carrier for the cover of the costs of hospitalization and medical care.

Non EU citizens, who own property in Greece, via a legal person of which they are the only shareholders:

  • Copy of a purchase contract as regards property of a minimum value of 250.000 €.
  • Declaration from the notary that the purchase contract is in line with the prerequisites of article 6 paragraph 2 of Greek law 4146/2013.
  • Certificate of the submission of the contract before the competent land registry.
  • Copy of the corporation charter of the legal person in which it will be indicated that the non EU citizen is the only shareholder.
  • Certificate of insurance carrier for the cover of the costs of hospitalization and medical care.

Non EU citizens with a ten year lease of hotels or accommodations of article 8 paragraph 2 of Greek Law 4002/2011:

  • copy of lease contract of hotels or accommodations with reference to the granting of license from the National Tourism Organization, in which it shall be declared the payment of the amount of 250.000 €.
  • Certificate of the submission of the lease contract before the competent land registry.
  • Certificate of insurance carrier for the cover of the costs of hospitalization and medical care.

FAMILY MEMBERS

  • Certificate of insurance carrier for the cover of the costs of hospitalization and medical care.
  • Recent marital status certificate from the foreign authorities which will prove the family ties.

C) According to article 36A of Greek Law 3386/2005 the non EU citizen can be accompanied by the members of its family to whom a registry permit is granted after their own submission of an application. Their registry permit can be renewed or ends simultaneously with the registry permit of the interested person.

As family members who have the right of entrance and registry are considered:

a. Spouses, who have completed the 18th year of ages, as well as their under 18 years old single children as well as the foster ones.

b. The single children of the one or the other of the spouses, including the foster children, under the condition that the interested person has the custody.

TAXATION

The amount of tax is 3 % on the total amount of the contract.

In case the non EU citizen purchases the property from a construction company and the construction permit of the property is dated after the 1st .1.2006, the tax is 23 % on the overall amount of the contract.

NOTARY FEES

The notary fee is calculated as follows:

  • 1 % up to 120.000 € value indicated in the purchase contract
  • 0,70 % from 120.001€ – 380.000 € value indicated in the purchase contract
  • 0,65 % from 380.001 € – 2.000.000 € value indicated in the purchase contract
  • 0,55 % from 2.000.001 – 5.000.001 € value indicated in the purchase contract
  • plus 500 € maximum expenses which will be altered per case plus 23 % VAT.

EXPENSES FOR THE SUBMISSION OF THE CONTRACT BEFORE THE LAND REGISTRY

Approximately 5 /000 is calculated on the value indicated in the purchase contract, plus 23 % tax calculated on the 3/000 of the value indicated in the purchase contract.

LAWYER‘S FEE

    • 1300 € including VAT 23 % for all the procedure until the singing of the purchase contract
    • 70 € including VAT 23% for the submission of the purchase contract to the land registry
    • 700 € including VAT 23 % for the lodging of the application and the granting of the registry permit for each person.
    • 185 € including VAT 23 % for all the procedure acquired for the connection of the purchased property to the power supply system and the well system.

245 € including VAT 23% for all issues against the tax authorities.

Total : 2500 €

NOTES

  • If the objective value of the property is higher than the purchase value then all the above taxes, fees and expenses will be calculated on this higher value.
  • All the required public documents must be certified with the Apostille of the Convention of the Hague. In cases where the Apostille is not needed, the documents must be certified by the Greek consulate or the Greek Ministry of Foreign Affairs as regards the signature of the foreign authority.
